The following terminology applies to these Terms and Conditions, Privacy Statement, Disclaimer Notice, Cookies Statement, and any or all Agreements: Client (“Users, User, You, Your”), Website (as known as “site”). These Terms and Conditions apply to the site and all products and services offered by ARK3 Marketing (also referred to as the “Company”). Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are taken as interchangeable and therefore as referring to same.

The Company may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit the Company site, register on the site, subscribe to notifications, and in connection with other activities, services, features, or resources the Company makes available on the site. Users may be asked for, as appropriate, such as an address, email address, and phone number.

Users, however, may visit the site anonymously. The Company will collect personal identification information from Users only if they voluntarily submit such information to the Company. Users can refuse to supply personal identification information, however, doing so may prevent them from engaging in certain site-related activities.

INFORMATION THE COMPANY COLLECTS

• Information a User provides to the Company when registering for a service (such information shall include, but may not be limited to, a User’s name, age, debit/credit card information, telephone number, postal address, and email address);

• A User’s usage of the service; provided to the Company in emails or letters sent by the User;

• Transactions carried out through the service, orders placed by the User, and the fulfillment of those orders;

• Data a User submits in order to use a service, including data relating to a User’s customers, clients, or others using the User’s services which the Company apps have access.

• It is possible to view the Company’s website without providing any personal details. However, without registering details a User will not be able to use services to their fullest extent.

• The Company may receive some information that a User submits to any third-party website or application used to access the service. Both the Company and the owner or operator of the third-party website/app will be the data controller in respect of any such information and the User should check the Privacy Statement of that website to learn how personal information is used.

• The Company will only use information collected from a User in accordance with this Privacy Statement.

HOW COLLECTED INFORMATION IS USED

The Company may use your information in the following ways:

• To ensure the User’s experience is delivered in the most effective manner for them and their devices used to browse the Company’s site;

• To provide a User with information, products, or services requested from the Company or which is believed to interest the User, where they have consented to be contacted for such purposes;

• A User or Client may opt-out from receiving marketing communications from the Company at any time by notifying them in writing, contacting them at info@ark3marketing.com, or alternatively, by following the one-step procedure to ‘unsubscribe’ that is specified in an email a User receives.

• Other than as expressly set out in this Privacy Statement or as otherwise required or permitted by law, we will not share, sell, or distribute any of the information a User provides to the Company without consent.

• Keep in mind that information posted on public elements of the site or service may be visible to Users throughout the world. Therefore, a User should be thoughtful and considerate when submitting information about themselves on any platform, site, or service.

• The Company may disclose a User’s personal information: (i) to any third party to whom disclosure is necessary to enable the Company to fulfill a User’s order and provide them with any service to which they have subscribed via the service; (ii) where required to do so by law or court order; and (iii) to any User to whom disclosure is necessary to enable us to enforce our rights under this Privacy Statement or under our Terms and Conditions.

• The Company may disclose a User’s personal information to a social media platform. It is always advisable to read their Privacy Statements, Terms and Conditions, and Cookies Statements.

THIRD-PARTY SITES

• The Company’s site may contain links to websites or access to applications that are operated by third parties. The Company does not control, nor accept any liability or responsibility for those websites.

• ARK3 Marketing’s Privacy Statement does not apply to any third-party sites. Please consult their Privacy Statements, Terms and Conditions, and Cookies Statements to learn how they collect and use data.

• Advertisements displayed on our site operate as links to the advertiser’s website and as such any information they collect by virtue of your clicking on that link will be collected and used by the relevant advertiser in accordance with the Privacy Statement of that advertiser.

HOW YOUR INFORMATION IS PROTECTED

• Similar to other websites, the data that the Company collects from a User may be transferred to a cloud service provider which has data servers, which are based outside the European Economic Area (“EEA”). By submitting your personal data, you agree to this transfer and the storing and/or processing of your personal data on these servers. We will take all steps as outlined in the Privacy Statement.

• Appropriate security measures will be adopted to protect your information from access by unauthorized persons and against unlawful processing, accidental loss, destruction, and damage. However, you acknowledge that data transmission over the Internet is inherently insecure and that we cannot guarantee the security of the data you send over the Internet.

• Your information will only be held for a reasonable period or as long as the law requires or permits.

ACCESSING YOUR INFORMATION

At any time, a User may request access to and/or, if incorrect, rectification of their personal data by contacting the Company at the address displayed in this Privacy Statement or by emailing info@ark3marketing.com. We reserve the right to ask you for proof of your identity and to charge you a fee of twenty US dollars ($20) to meet our costs in granting any data access request you make.

CHANGES TO THE PRIVACY STATEMENT

A User is encouraged to review this statement periodically when returning to the site as the Company may update it from time to time to reflect changes to its practices, new requirements, and new security risks and safeguards. The changes become effective upon posting the new version of this statement, and those changes that relate to the use of personal information apply to information that is collected after posting.
